The U.S. Department of Treasury with the Internal Revenue Service (IRS) issued the final regulations on January 17, 2013 for The Foreign Account Tax Compliance Act (FATCA). The regulations provide clarification around the classification of a financial institution, what an acceptable certification document is, and a timeline for institutions to be compliant.
Despite the regulations being published, many institutions in Asia still have questions around whether an Intergovernmental Agreement (IGA) will be signed within their jurisdiction, and possibly of more importance, which of the FATCA rules an institution will need to comply with.
